While there is still only talk and no specific laws enacted in Australia allowing for same sex marriages, it is significant to note that the legal rights and entitlements of same sex couples in relationship disputes (with or without children) are the same as those for heterosexual couples. Any person involved in a relationship may have a claim to a property settlement upon the breakdown of that relationship, including a same sex relationship. Married, same sex de facto and heterosexual de facto couples all have the same remedies available to them whether it is in the form of a pre-nuptial agreement at the commencement of a relationship or asset splitting remedies and parenting arrangements at the end of a relationship.
