If you are doing a property transfer as a consequence of a divorce or de facto relationship breakdown, it is recommended that you obtain legal advice from a family lawyer in the first instance.
If you have a mortgage on the property any transaction will require the approval of your bank. Therefore, ring your bank, explain the situation and obtain approval to transfer the property from two into one name. Without the bank giving approval to such a transaction you cannot proceed.
